The banks and the OFT have been back in the High Court this week to allow Lord Justice Smith to consider the effect of historic bank agreements on the issue of bank charges and the jurisdiction of the Oft over these.

The last test case only concerned itself with current agreements and the Court found that the OFT do have the right to consider the fairness of charges under the Unfair Terms in Consumer Contract Regulations - although the banks have appealed this decision to the Court of Appeal and this appeal is due to be heard after the summer.

The issue of historic agreements is just as important if not more so to consumers who wish to reclaim charges incurred within the last six or so years.

Unfortunately, although somewhat predictably, the Court stated that there would be no quick decision and L.J. Smith will now consider the information over the course of the next few months.

The decision of the OFT in relation to the fairness of bank charges is due before the end of July and they have given the first indication of the amount of charges the banks take from consumers every year. The Oft have stated that the banks coffers are swelled by up to £2.5Billion ponds a year thanks to these charges! An amazing amount of money - no wonder then that the banks have indicated that they will ignore the OFTs recommendations and will pursue the issue of fairness of charges to a test case in the Courts scheduled for the end of the year.

With the banks already indicating that they will appeal both decision to the House of Lords and possibly the European Courts it may be some considerable time yet before the issue of recoverability is decided.
